Read the Takedown Letter that Jake Gyllenhaal’s Lawyer Sent us Over the Photo that we will not be Removing
Jake Gyllenhaal’s lawyers know that you’ve been thinking about him in his underwear, and they are not amused.
Queerty got an email this afternoon from Jake’s law firm, asking that we remove the (probably fake) photo of him in his undies. We’re keeping the photo up, since it hasn’t been proven fake and because their letter bumped it from “funny and cute” to “actually newsworthy.”
“Your publication of this fake photo violates many legal rights of our client by, among other things, defaming him,” says Jake’s lawyer.
Oh, really? Defaming him? Well, we don’t like defaming anyone. You might even say that we are gays and lesbians allied against defamation.
But what exactly is the defamation here? Is is that people might think, wrongly, that Jake wears underpants? Or that his reputation is sullied by the idea that he allowed someone to photograph him without pants on? Or that he stayed in what looks like a cheap motel?
Simply calling something defamation doesn’t make it so, as Howard Stern learned in 2009 when he tried — and failed — to sue someone for suggesting that he’s gay. Is that what’s going on here?
Jake’s a public figure, and we can talk about him if we want to. We can even speculate about what he looks like in his underwear. We can’t — and won’t — claim that this picture of him is definitely authentic, since we just don’t know. (A lot of people seem to claim that it isn’t, but internet-photoshop-experts are about as reliable as internet-lawyers.)
In any case, if Jake wants us to take down a fake photograph of him in his underwear, all he has to do is provide us with a real photo and we’ll gladly post that one instead.
After the jump: read the lawyers’ letter.
Ladies and Gentlemen:
Our law firm represents Jake Gyllenhaal. Your website has published a picture which purports to be a photo of our client in underwear imitating an album cover pose of singer Grace Jones. In fact, as anyone could tell from a cursory examination, this is a fake picture, in which our client’s head has been pasted on the body of another person. A number of websites have already taken the photo down in response to our request, and most of the remaining references to it on the web acknowledge that it is a fake. The photograph in question can be found at http://www.queerty.com...
Your publication of this fake photo violates many legal rights of our client by, among other things, defaming him, portraying him in a false light, violating his right of publicity and constituting a false designation of origin in violation of the Lanham Act. Demand is hereby made for immediate removal of the fake picture.
If you fail to immediately remove the fake picture, our client will take such action as he may deem appropriate to protect his rights, which may include, without limitation, an action against your company for actual and punitive damages and injunctive relief.
This letter is not intended and should not be construed as a complete statement of all relevant facts or a release, waiver or relinquishment of any right or remedy, all of which are reserved.

Sorry cremepuff, Jake has every right to protect his image if he wants, when he wants. You don't get to choose for him. His image is for sell if he wants it, so get over yourself and stop hating. For what ever reason, he does not like it and wants it removed.
'For what ever reason'?!? LMAO!
Good for Jake. If someone sold photoshopped pics of me as real, I'd object too. Don't get the criticism towards Jake also on WFT2.
It's a stupid fake photo, I'd be embarrassed too if I were Jake.
Jake didn't complain about this photoshopped pic:

Thank God Jake isn't embarrassed about posing for paparazzi!
Leonardo DiCaprio & Blake Lively
Leo, Haas and Blake.
I'm sure if Blake is Leo's new beard, she won't mind his supposed thing with Haas. ;)
Bearding for a powerful Hollywood player like Leo, will bring her a lot of benefits (if she is his new beard that is).
Jake and Heath didn't object to that pic either.
fake Jeath
I'd be embarrassed too if I were Jake.
Jake is embarrassed about those socks! lol
I understand why he didn’t want it up. It made him look like a short, hairless, feminine man. That is bad for his image. Most fakes make him look manly so it doesn’t bother him. Also, big websites don’t post them. This one was made to mock him and make people laugh at him. NO ONE likes to be laughed at like that.
I bet if he was a bigger star websites would have made a deal before posting it.
He can’t win either way.
This one was made to mock him and make people laugh at him.
That is not true.
Photo is still up: http://ohnotheydidnt.livejournal.com/59282611.html
NO ONE likes to be laughed at like that.
Jake choosed to do PoP, I think he doesn't have a problem with that.
NO ONE likes to be laughed at like that.
Jake choosed to beard with Taylor Swift, I think he doesn't have a problem with that.
Kirsten Dunst is getting rave reviews at Cannes. Maybe she'll get an Oscar nomination this year.
I understand why he didn’t want it up. It made him look like a short, hairless, feminine man. That is bad for his image. Most fakes make him look manly so it doesn’t bother him.
Exactly, Jake was bothered because he hates being seen as gay.
Fake Jake Gyllenhaal/Grace Jones Photo Not As Fake As Other Fake Jake Gyllenhaal Photos
May 17th, 2011
The photo on the left made the rounds yesterday and was of no interest me (you’ve seen one Photoshopped photo of Jake Gyllenhaal, you’ve seen them all), and today his reps are emailing all the blogs demanding that the fake photo be removed. It’s already been pulled from Dlisted and E!, and Queerty might be next, according to editor Oscar Raymundo. Suddenly, I am interested in this photo!
If the photo is fake, as Gyllenhaal’s reps are claiming, that makes it satire. And Jake Gyllenhaal, who is a movie star, is legally allowed to be satirized.
Unless one of Jake Gyllenhaal’s lawyers can explain to me why this satirical photo’s existence is illegal, the photo stays.
Meanwhile, why get mad about this phony picture when there are so many more phony Jake Gyllenhaal pictures that actually show phony Jake Gyllenhaal cocks?!
Not Safe For Work!!!

Got to love his practical approach! lol
Unless one of Jake Gyllenhaal’s lawyers can explain to me why this satirical photo’s existence is illegal, the photo stays.
Good point! Why is this photo illegal, what exactly is wrong with it when all other fake photos of Jake are OK?
Thank God Jake isn't embarrassed about posing for paparazzi!
^ what a stupid comment!
and self serving
Exactly, Jake was bothered because he hates being seen as gay.
everything is about GAY to you.
It's sad.
There is more to a persons life than their sexual preference, but obviously you are not aware of this, so it's all that matters to you.
Sad, disturbing and stupid.
8:32 AM - what is stupid about pointing out how Jake is fine with making a fool of himself in public, posing with beards and faking, but uses lawyers to take down some silly fake photo? Is it possible that Jake expects respect because it is OK to fake an lie if you have money?
8:37 AM - your homophobia is sad, disturbing and stupid.
There is more to a persons life than their sexual preference, but obviously you are not aware of this, so it's all that matters to you.
Sure, Jake hired lawyers to scare bloggers because those socks are "defaming him, portraying him in a false light". LMAO!
This one was made to mock him and make people laugh at him.
What is there to mock and laugh about? Give us details, because I don't see why would anyone choose such meh photo if you are right.
Whatever he has done, he has chosen to do. The photo going around for laughs he did not choose. Cropping it and trying to get a few extra miles out of it is funny.
9:08 AM - do you have an opinion or anything to share? Or you are here just to insult and troll?
The photo going around for laughs he did not choose.
So far I didn't see any laughing comments about the photo. Link, please!
Go look for yourself, or check your mirror. Plese post for all to see the comments that disagree with this tactic also when you do.
Having taken Jake's face off the photo says it all, I think.
The fact that Dlisted and E! took it down immediately raises them in the respectability notch IMO, and Ted always did have class. MichaelK may not like that, he'll lose his street cred! JK I love him.
Great post Jackie.
everything is about GAY to you.
It's sad.

Sad, disturbing and stupid.
Actually the person you are describing is Jake. Jake being gay and in the closet seems to drive almost everything we see him do in public, including his reaction to this photo, and in turn that is what leads us to talk about the things we do.
I fail to see what is so wrong with this picture that it would cause Jake to get lawyers involved, other than Jake having a problem with anything that makes him look gay.
Go look for yourself
I've looked and that is how I know that there aren't laughing comments about the photo.
You are making shit up and that is why you can't post any links.
I think it's the motivation behind the photo.
The fact that Dlisted and E! took it down immediately raises them in the respectability notch IMO, and Ted always did have class.
You should read comments.
From Jake's lawyers letter: "Your publication of this fake photo violates many legal rights of our client by, among other things, defaming him, portraying him in a false light, violating his right of publicity and constituting a false designation of origin in violation of the Lanham Act. Demand is hereby made for immediate removal of the fake picture. If you fail to immediately remove the fake picture, our client will take such action as he may deem appropriate to protect his rights, which may include, without limitation, an action against your company for actual and punitive damages and injunctive relief."
They complied.
E/Ted never posted the poic, he just posted a link to it so there was nothingto delete.
Slisted took it down, PITNB took it down before the letter because Trent realized it was fake.
The rest of the blogs that have either deleted or chose to leave it up, it doesn't matter because nothing will be done by his lawers, it's all free PR for Jake and his team.
I wouldn't be surprised if it was his team that did it, they sure took there time in issuing the letter...
it's all free PR for Jake
Bad PR for Jake.
Speaking of actors in their underwear, JGL's still photo for Hesher is like a work of art. The lighting, the shutters, the faded patterned couch and the way he's draped over it, the cigarette smoke, and the take me as I am attitude, totally at ease. Gorgeous.
Very bad PR for Jake. Nothing worse than looking like a sourpuss with no ability to laugh at himself. Particularly, since he is gay and has been creating his own parody of what a movie star should look like for years.
what is stupid about pointing out how Jake is fine with making a fool of himself in public, posing with beards and faking, but uses lawyers to take down some silly fake photo? Is it possible that Jake expects respect because it is OK to fake an lie if you have money?
How is it that you don't realize that your above statement is nothing more than your interpretation of his life.
It's all in your mind and you have decided that it's the truth because you want it to be.
How can you not see this?
That's the question you should be asking yourself!
Very bad PR for Jake. Nothing worse than looking like a sourpuss with no ability to laugh at himself.
ITA. Fake Taylor Swift photos were way more embarrassing than this and he posed for those!
That's the question you should be asking yourself!
10:23AM, the questions you should be asking yourself are: "Why am I banging my head against the wall trolling a blog I don't like? Why do I spend my time reading it and trying to change people's minds? Why am I so bothered that people think Jake is gay? What can't I see that I'm not going to change anyone's mind? Why don't I spend my time over at blogs where Jake is universally loved and admired and never criticized?"
How is it that you don't realize that your above statement is nothing more than your interpretation of his life.
It's all in your mind and you have decided that it's the truth because you want it to be.
You choose to ignore the truth.
You want Jake to be straight.
Jake bearded with Witherspoon and Swift - they and their PR teams made mistakes, they were caught in lies, and we are not the only ones who paid attention and know about showmances and Jake's gayness.
Mark_Wheaton: Maggie Gyllenhaal announced as lead in "Voice from the Stone" - http://www.variety.com/article/VR1118037271?refCatId=13

EXCLUSIVE: Maggie Gyllenhaal has signed up to topline Eric Howell's supernatural thriller "Voice From the Stone," which K5 International is selling here in Cannes.
Pic, produced by Dean Zanuck and Stefano Gallini, is based on the Italian novel "Le Voce Della Pietra" by Silvio Raffo.
Story sees Gyllenhaal play the role of a nurse drawn to the aid of a young boy who is haunted by malevolent forces within the walls of an old house in the Italian countryside. As she develops a relationship with the father of the boy, she also becomes haunted by the same evil presence and must fight to save herself and the boy.
Gyllenhaal is currently filming "Still I Rise," helmed by Daniel Barnz, and will also star in romantic comedy "Hysteria" with Hugh Dancy.

Jake Gyllenhaal doesn't like fake scantily clad photos of himself on the internet
When a photo of Jake Gyllenhaal goofily posing like Grace Jones in her underwear emerged on the internet, many of us thought it was too good to be true. And of course it was (pretty obviously) Photoshopped, but still worth a chuckle. However, real Jake was not amused with fake Jake. He was so irked that he had his lawyers contact Buzzfeed (the site largely responsible for disseminating the pic) with a strongly worded letter urging them to take the photo down and threatening legal action if they didn't. You can read it in its entirety below. We're guessing they're not big fans of flamboyant, experimental disco-funk.
I'm not sure why he's getting so riled up over faux-shirtless photos. It's not like there's a dearth of authentic ones on the internet, or even on his movie posters. His nearly-nude body plastered billboards and magazine covers for months during Love and Other Drugs promotional blitz last fall. Perhaps he wants people to know which abs are truly responsible for his floundering movie career.

Ouch.

Still, I have a feeling that the big hit on the BBC's new slate will be My Week With Marilyn, an account of the time Marilyn Monroe spent in Britain in 1957, filming The Prince and the Showgirl opposite Laurence Olivier. Michelle Williams plays the effervescent sexy Marilyn, while Kenneth Branagh plays Olivier -- an irony, this, as he was tagged 'the young Olivier' (not always kindly) in the early part of his career. Eddie Redmayne has what looks like a career-changing role as a young production assistant whose job it is to escort the wayward Marilyn in her downtime.
The reason I think My Week With Marilyn has a future was the reception its trailer received at a big splashy party thrown here in Cannes at the weekend by the Weinstein Company, which will distribute the film in the States. Company boss Harvey Weinstein screened half a dozen titles, and My Week With Marilyn -- which looks very affecting and amusing -- generated spontaneous, enthuisiastic applause.

Fingers crossed :)
Jake seems to be morphing into Tom Cruise. Having his team of lawyers ready to sue at the slightest hint of him being gay. I wonder if he's using Tom's notorious lawyer, Bert Fields.
Its sad that the most homophobic people are often gay themselves.
Jake is either morphing into Tom Cruise, or Ennis Del Mar. That's what I call sad beyond belief.
I think Jake would sign a pact with the devil for Tom Cruise's career and closet.
This is excellent. Christian Bale has a twitter account. You can follow him at @AUS10NICHOLS.

What is this, Jake and Austin's how to be uncool week?
Was Austin ever cool??
Yes, he was - before Twitter! lol
"Kirsten Dunst is getting rave reviews at Cannes. Maybe she'll get an Oscar nomination this year"
HA!
I so doubt it.
She is damaged goods. HW love men-comebacks, women can't return from hell. Plus, she never was a great talent and nobody cares for her anymore
Michelle has god chances of earning an AA. Weinstein is determined to make her happen, if it's not this year it will be the next one.
Weinstein will get Meryl Streep the Oscar this year.
Meryl deserves Oscar every year.
Most critics think Kiki is good actress and take her seriously. Maybe she isn't loved enough in HW to ever get an Oscar, but that is true of some of the best actors, directors, etc. who've worked in HW.
at the slightest hint of him being gay.
You're joking, right? Really? The slightest hint? Jokes and rumors have been going on for years, and he's shown remarkable patience and a sense of humor about the whole thing.
he's shown remarkable patience and a sense of humor about the whole thing
He did that by lying he's straight and by bearding?
Most critics think Kiki is good actress and take her seriously.
She's OK, nothing to write home about.
Harvey Weinstein is all about the winning which is why he bought the US rights to Iron Lady with Meryl Streep. It's a puzzling move because he already had the rights to Michelle's Oscar baity Marilyn film. Maybe he's not too confident in it.
Jake has shown a remarkable sense of patience and humor? Are you serious? The guy's not only been lying to fans for years, but actively creating a false identity that elevates heterosexuality to the pinnacle of esteem. I remember last year when he was coming out of the Giorgio Baldi Restaurant with Maggie and Peter and the reporter simply asked him about Prop 8 and he put his hand up like get away from me and said, "Yeah, yeah, yeah, yeah."
He has shown not just a complete disregard for the truth, but an impetuous desire to eradicate all evidence of who he really is. Patience would not be the word I would choose to describe his behavior. How about petulance and peevishness, with a huge dose of pugnacity.
Very melodramatic.
You know, I was just reading about George Clooney. And I thought about him with respect to the silly photoshopped Jake/Grace Jones photo. Could you all honestly see George Clooney siccing his lawyers on websites if a similar shot of him appeared on the net?
Very melodramatic.
The truth can never be too overdone. Besides, Jake wouldn't tolerate me be overly dramatic or theatrical. Much too gay!

I doubt even Cruise would have done anything but laugh at it. Jake is just pissed he can't pull it off. He has done everything but walk down the isle in a wedding dress. I hear wedding bells.
Could you all honestly see George Clooney siccing his lawyers on websites if a similar shot of him appeared on the net?
Clooney's a cool customer. He'd make a joke of the whole thing and use it to his advantage.
LOL! Yeah, 7:37PM you better be careful. Jake may sue you for a total disregard of the...oops! That's right. You can't seek a legal remedy when someone is simply having some fun. Particularly, when whatever your afraid us hits so close to home. Sorry Jake! Looks like your bluff didn't work. There's still several sites which still have that "defamatory" pic posted.
if Jake did not like the picture that he did not approve, he has every right to insist on it being taken down.
^ No he does not. Haven't you ever heard of parody laws or freedom of speech? Just because someone has a stick up their *ss doesn't mean they get to squelch ironic or farcical content from the Internet. We ain't a totalitarian state yet. Although I have no doubt that Jake and his people would like nothing more than for only their lies and misrepresentations to rule the day.
Oh yes it does, cupcake. (sorry, that was my right to parody).
Haven't you ever heard of parody laws
EXCEPT that photo was never passed off as parody. It was shopped as "the real thing".
Oh yes it does, cupcake. (sorry, that was my right to parody).
Sorry sauerkraut snookums, but you need to take not only a law course, but English as well. Your indefinite pronoun demonstrates just what an incoherent argument you have just made. Jake is a public figure. He can be satirized ad nauseum. Part of established law and living in a free country that has not been completely taken over by the corporate bosses.
The photo was an obvious fake. Give me a break. It wasn't shipped as anything. Just like several fake photos of Jake over the years. I can't say the same for the Jake and Taylor in Love spread though. Hey, maybe we can all get together and file a class action suit against Jake's people. We could charge them with an obvious falsehood to promote personal wealth. Hey, isn't that called fraud? LOL!
Ha! Looks like Jake may have opened a can of worms. That's why he should have just laughed it off.
Was the C&D letter even real? It sounds like a way to ge a little more traction.
Uh, you can't really get away with impersonating a lawyer.

Sex Drugs and Rock & Roll
The heteros can keep Steven Tyler, thank you very much!
Why would anyone not want to claim that body is his? I mean look at the curve on that ass. Mesmerizing! ;-D
That photo did nothing for him. Several sites now have the same headless photo as posted here and that makes it even more funny since we all now know its Jake. He looked gayer in the POP stills than in that photo. It does not cost much for a lawyer to write a letter. I doubt they ever intend to take it any further since they have minimal chance of proving any damages. What happened? He lost a part retroactive because of it?

Your loss, Steven!

This is Jake's way to show producers/studios he's serious about fighting gay rumors? Jake is nervous about something? Jake took bad advice from someone?
I'm looking forward to Steven Tyler's book. I saw him promoting in on a television show, he's wild, funny and sexy, even now.

slashfilm: Cannes Bans Lars Von Trier http://bit.ly/jz72sG
The question concerned the director’s German heritage, and his answer was:
For a long time I thought I was a Jew and I was happy to be a Jew, then I met Susanne Bier and I wasn’t so happy. No, that was a joke, sorry… But it turned out I was not a Jew, and if I had been a Jew I’d have been a second-rate Jew, because there’s kind of a… hierarchy in the Jewish population.
But no, I really wanted to be a Jew but then I found out I was really a Nazi. Because my family was German, which also gave me some pleasure. What can I say? I understand Hitler… I think he did some wrong things, yes absolutely.
But I can see him sitting in his bunker at the end… What? There will come a point at the end of this… I will…No, I’m just saying I think I understand the man. He’s not what you would call a “good guy” but I understand much about him. I sympathize with him a little bit. I don’t mean I’m in favor of World War II and I’m not against Jews, not even Susanne Bier. That was also a joke. In fact I’m very much in favor of them. All Jews. Well, Israel is a pain in the ass but… Now how can I get out of this sentence? [laughter] No, I just want to say about the art- I’m very much for… Speer, is it? Albert Speer I liked. He was also maybe one of god’s best children, but he had some talent. It was possible for him to use during… [giving up] Ok. I’m a Nazi.
Susanne Bier (born 15 April 1960) is a Danish film director best known for her commercial features After the Wedding and the Academy-Award-winning In a Better World.

Stupid people bum me out. :-/
It just seems odd that of all the pics to call in the attorneys for, this silly one would be it. It's no different than many others that get photoshopped of him. How difficult would it be to print a boiler plate C&D, slap an LA law firm's name on it, and get a little extra mileage out of the pic? Not very. I haven't heard his people come out about the pic, nor Ted or anyone else refer to getting letters? Or am I mistaken? :)
As far as I know, Jake's people didn't comment the photo, but a lot of bloggers blogged about getting e-mail from Jake's lawyer - see 5:23 AM link.
How difficult would it be to print a boiler plate C&D, slap an LA law firm's name on it, and get a little extra mileage out of the pic?
This extra mileage is bad PR. What would be the point of faking C&D? Who would do it and why?
I agree that calling in the attorneys doesn't make sense, but faking something like that makes even less sense.
Less sense and also a felony.
The same person that photoshopped the pic, could have faked the C&D letter too, they would have all the reason to keep this crap going.
It was very easy to get Jake's lawyer's name, address, email, etc. Remember the C&D letter this lawyer sent to that real estate agent in SC when he was filming Nailed? They posted the address of where Jake was staying and the real estate agent posted the letter, it's very easy for any on to copythat info and keep in on file for future use.
E/ted never actually posted the pic, just linked to it. Then he claimed that he heard from his people that it was fake (which i don't buy because he knew in the begginning it was fake, he couldn't be that dumb) then he said you better get a good look because his lawyers were going to ask to have it removed from all sites, again I find it hard to believe Jake's people would be talking to Ted about anything.
Also that letter is very unprofessional, doesn't sound like a lawyer talking here, and yet if it was fake why hasn't anything being done? It's all very odd.
E wasn't sent the letter since they didn't post the pic.
Something is off about that letter.

Jake's people wouldn't ignore something like that and law firm wouldn't ignore something like that.
Nah, I'm pretty sure the C&D letter is real. It's not the first time Jake threatened a website with legal action, remember that jerk DSF?
The thing is that the letter was put out there w/o the e-mail, cell#, etc redacted, just like the S. Carolina letter, that's a no-no and zi don't think that the real estate agent redacted that info, meaning that Jake's lawyer doesn't sem to concerned about having that info on the net. Also he sent a letter to Drunken stepfather about that incident in Montreal and asked him to take the post down.
He said he wouldn't take it down and I don't think he did and i don't know if he posted the letter.
I bet people e-mailed that office or called, not cool at all.
IMO, the letter came from that office but it wasn't from the lawyer but one of his assistants. He may have told Jake to let it ride but maybe Jake insisted and had a assistant do it and the lawyer just can't be bothered to do anything considering a few site have refused to take it down even after they got the letter.
The letter said that it's from the office of the law firm not Richard Thompson, so it was someone in the office. The phrasing of the letter suggests someone barely out of HS.
I bet people e-mailed that office or called, not cool at all.
Who would e-mail or call Jake's lawyer and what about?
IMO, the letter came from that office but it wasn't from the lawyer but one of his assistants.
Lawyers get paid to write letters like that + There is more than one law firm in LA = there can't be any reason for Jake to fake a letter.
Wow, even UV thinks Jake's people are idiots for the way they handled the whole photoshop pix and for having attorneys issue a letter.
Who would e-mail or call Jake's lawyer and what about?
People who have watched "A Few Good Men" a few too many times? You know yelling at the lawyer dude " YOU CAN'T HANDLE THE TRUTH!" ;)
Wow, even UV thinks Jake's people are idiots for the way they handled the whole photoshop pix and for having attorneys issue a letter.
Bitch!
You know yelling at the lawyer dude " YOU CAN'T HANDLE THE TRUTH!" ;)
Great scene! But still don't get what you're saying.

Jake Gyllenhaal sues over underwear photo
Lawsuit alleges image violates star's rights by 'portraying him in a false light'
Jake Gyllenhaal's lawyers are scouring the Internet, attempting to eradicate a picture of the actor that shows him stretching in his tighty-whitey underwear.
The letter was sent to a few websites, including Queerty.com and Buzzfeed.com. Gyllenhaal's lawyers claim that "as anybody could tell from a cursory examination, this is a fake picture, in which our client's head has been pasted on the body of another person."
Gyllenhaal's pose in the photo is said to resemble an album cover pose of singer Grace Jones. The photo might be a nuisance to Gyllenhaal, but the legal campaign seems to have backfired. "We're keeping the photo up, since it hasn't been proven fake and because their letter bumped it from 'funny and cute' to 'actually newsworthy,"' reports Queerty.com.
Indeed. Gyllenhaal's lawyers allege the photo violates the actor's legal rights by "portraying him in a false light, violating his right of publicity and constituting a false designation of origin in violation of the Lanham Act."
At least one photo expert believes the image is a fake, so perhaps Gyllenhaal isn't stretching. No, maybe just his lawyers.
First, does the picture really damage Gyllenhaal's reputation? Jake isn't the first actor to allege defamation by photoshop — see Demi Moore vs. W Magazine — but this is a pretty unique situation. Maybe Gyllenhaal believes he won't earn big bucks as a leading man if people think he prances around in his underwear (and allow himself to be filmed as such).
As for the publicity and Lanham Act claims, Gyllenhaal might have to trot out experts testifying to the value of a market in Gyllenhaal underwear photos being damaged by the appearance of this image. Who knows? Maybe Gyllenhaal really could be the paid spokesperson for Fruit of the Loom. We'd love to see the briefs. The legal ones, that is.

Jake has to have the most inept PR people and advisers in the world.
Yahoo reports too.

"Dear Ted:
Assuming I have correctly guessed the identity of Toothy Tile's better half, Mr. Grey Goose, would it be safe to state at this point that Grey had moved on to safer waters and a shyer new man? Still miss though the days of ol' Toothy getting spotted hanging with Grey Goose. They were so cute together! Romantics at heart want to know your spin on this one.

Good job, Jake. Now that this is being reported by msnbc and yahoo, all the people who never saw the pic will be looking for it.
...
We're not sure how the photo is defamatory ... that could be hard to prove in court. It's just Jakey in his undies (again, supposedly.) Maybe that's why the sites have yet to remove the pic ...
We wonder what belt he is.
Jake is currently filming End of Watch, in which he plays a cop. He shaved his head for the role, though he has hair in the pic. Still, it could be old. Or fake, right lawyers?
♫♫♫ Shake your groove thing, shake your groove thing! ♫♫ We are gonna be rich!
LOL :)
The C&D letter is backfiring on Jake badly. What a mess.
ONTD
Nobody cares about ONTD M.
Keep playing stupid, LMAO!
Jake is an idiot if for no other reason than hiring inept PR people who do shit like set him up with Taylor Swift, and decide to take legal action over a photoshopped pic of him in a yoga pose.
This photo doesn't even come close to a "repose" of the Grace Jones cover. It's called dancer pose and I do it every single day, often in my underwear. Anyone who practices yoga does this pose for balance and stretching quads, often in the morning.
If this pic were real, I'd think nothing of it except that his slumber partner got a little handy with the camera.
If it's fake, it came from somewhere, and probably from someone who comes around here or OMG from time to time. To you, I say, congrats. You could make a fun little photo hobby out of pissing ego-centric celebrities off big time!

It's possible, but i think you are giving to much credit to regular OMG posters. LOL!!

Well, when you put it like that... it sounds great! ;)

Thanks for the idea! How much is Adobe Photoshop going to run me?

From 19 May 2011. "I wouldn't have it any other way"???
LOL
Jake Gyllenhaal is interviewed in the next issue of the German magazine 'In', which is published today.
We only have a snippet from the interview so let's just hope we see more, because there be goodies here. 'Sometimes my mother and my sister get a little bit on my nerves... We're just a family. That's enough'. And there's a little about finding that right person: 'It's just important for me that I can immediately feel comfortable with a woman... If you ask a woman out on a date, you often feel as if you're running through a minefield'.

WDW Kate pretends that yoga photo and C&D letter never happened. LOL!
From 19 May 2011. "I wouldn't have it any other way"???
Meaning Ted prefers Jake with Austin to single or with someone else.
The question is - is that the reason Ted insists Jake and Austin are together when everyone who is interested can see that they aren't?
WDW Kate pretends that yoga photo and C&D letter never happened.
More ass kissing.
LOL! No-one cares what Ted says anymore
It's just important for me that I can immediately feel comfortable with a woman... If you ask a woman out on a date...
Jake, I'm sure you are comfortable around ANY woman, LOL!
And there's a little about finding that right person: 'It's just important for me that I can immediately feel comfortable with a woman... If you ask a woman out on a date, you often feel as if you're running through a minefield'.
God, not this again. How many times has he repeated some version of this? Trying way too hard, Jake. Plus, what is he saying that anyone wouldn't already know? No shit you want to feel comfortable with someone. Who wants to feel uncomfortable?

May 08 - May 16: Jake and Austin were in LA at the same time for 8 days. Husbands and parents!
Is Austin still in New York with Sophia?
But who is thinking of the children?
Nannies, families, Atticus, friends, random strangers - so many options!

Then Austin can't be far :)
The loons at OMG claim Jake has a hickey on his neck, and that is evidence that he is married to Austin LOL!
*runs to check that out*
OMG has become a parody, sort of like that Elijah Wood site several years back caled Elijah Wood is gay, gay, gay!!! But in that case the girl that ran it had a sense of humor and had her tounge firmly in her cheek.
My favorite was pics if Elijah posing with small animals and baked goods proved that he was gay, gay, gay!!!
*runs to check that out*
Couldn't find anything suspicious on Jake's neck. Damn.
^ Does that really surprise you considering it is just SK fiction.
Ha, ha, the y wouldn't know what a hickey was if it hit them in the face!
I was involed in the LOTR fandom and I remember that E. Wood site. I also remember the insanity about the hobbits all being gay and Elijah and Dominic Monaghan being kept apart by evil PR, them giving shout outs to their "supporters" buty wearing each others cloths and wearing rings, forced to beard with icky girls and how they almost took over the DL! They gave them their own area called the Prancing pony inn to keep them off the main site.
I kinda miss all that craziness, with this Jaustaloon shit, it's just pathetic.
Couldn't find anything suspicious on Jake's neck. Damn.
LOL. SK has a big red arrow pointing at a zit. You can't make this shit up. Funnier than an SNL parody.
Someone's carrying on their own conversation.
SK has a big red arrow pointing at a zit.
Fuck!
It looks like a razor bump to me.
Even if that was a hickey and Jake and Austin were together, chances that Austin would do that to Jake (passionate sex) would be next to zero.
Since I don't believe as the Mormons do, do I still go to their services and regularly hang out at their meetings to see what's going on?
Only if I'm insanely curious about what they're saying in those temples.
5:45 PM - yes, you should hang out at their meetings if you're interested in discussing their believes.
7:04PM - weak
What is weak? I don't visit OMG any more, but I've posted there for years, so why shouldn't I visit if I feel like it? Or visit any other Jake fan blog or site?
Congrats to Jeff Nichols for taking home prizes at Cannes. This guy is outstanding. Watch Shotgun Stories and Take Shelter when it opens.

Jake Gyllenhaal doesn't want you looking at him in his underwear.
Actually, that's not necessarily true. What he doesn't want is you looking at pictures of him in his underwear that he claims are actually just his head Photoshopped onto someone else's body... and he's willing to take legal action to make you stop.
Lawyers for the actor have sent letters to various websites, including Buzzfeed.com, asking for the photo to be removed because the image violates his legal rights, ""portraying him in a false light, violating his right of publicity and constituting a false designation of origin in violation of the Lanham Act."
The letter says that, "as anybody could tell from a cursory examination, this is a fake picture, in which our client's head has been pasted on the body of another person." Will the letter having the opposite effect from its intended one ? Admit it, you want to see the image more now than you did before, don't you? As Queerty.com, which received one of the letters, put it, "their letter bumped it from 'funny and cute' to 'actually newsworthy'." I can't help but wonder why this suddenly seemed like a good idea to either Gyllenhaal or his legal team.
The internet is filled with Photoshopped fakes of celebrities, many far, far worse and more "violating" than this particular image, and no-one takes them seriously. What is so terrible about this one image that it requires this kind of overreaction? I'm imagining somewhere, some big name director talking to him and saying "I was all ready to give you this big role, and then I googled you and saw you in your white boxers and thought, nah, maybe not."
http://techland.time.com/2011/05/20/photoshopped-gyllenhaal-makes-real-gyllenhaal-upset-litigious/
Once again Jake and his PR team have hit another PR homerun. The whole attorney C&D letters have made him the talk of the internet and not in a good way and have doubled the interest in the picture. Even sites that would probably never discuss Jake, like techland.time.com, are laughing at him for not having a sense of humor, for picking such a lame manip to sue about, for the pic really not causing his career to suffer because it's already failing and for doubling the interest in the pic. When will Jake finally smarten up, grow a spine and fire his management and PR teams and get new ones. They truly sabatoge his career.
a lame manip to sue about,
He's not suing anybody.
He's not suing anybody.
His lawyers are threatening to sue. If they're not serious about that, then there is no point in issuing the C&D and they look like fools. Since Queerty refused to take the picture down, let's see what they do.
His lawyers are threatening to sue. If they're not serious about that, then there is no point in issuing the C&D and they look like fools.
I actually hope they move foreword with a suit. It'll be fun to see how many parties they bring into the complaint - from blog owners to web hosting companies to ISPs. I suspect once all those other parties are enjoined in the complaint Queerty and the other sites will take that pic down pdq, lol.
If Jake and his people had just ignored all of this, the story would have died by Monday. But here it is Friday, and people are still writing stories about it. Even an industry paper, THR, said he did the wrong thing.
I actually hope they move foreword with a suit
This won't happen. That would be an epic clusterfuck. Jake isn't the only one with a legal team and any suit would not be a slam dunk, but rather a long protracted and messy fight and that is the last thing Jake's team should want. Talk about opening up a can of worms.
I actually hope they move foreword with a suit.
They don't have a case, there is nothing about the photo "defaming him", Jake is gay so there is no "false light" and suggesting gay isn't defaming:
Your publication of this fake photo violates many legal rights of our client by, among other things, defaming him, portraying him in a false light, violating his right of publicity and constituting a false designation of origin in violation of the Lanham Act.
They truly sabatoge his career.
They are hired by Jake, they work for him, they are paid by him so Jake is satisfied with their job.
Jake is 30 and it was his decision to send C&D letters. The question is - why? What made him do it? What was his goal?
Jake Gyllenhaal Alleges Defamation Over Underwear Photo
Jake Gyllenhaal's lawyers have ordered several websites to take down a picture of the actor showing him stretching in his underwear, according to The Hollywood Reporter.
Attorneys for the Brokeback Mountain actor, 30, claim that "as anybody could tell from a cursory examination, this is a fake picture, in which our client's head has been pasted on the body of another person." The letter was sent to Queerty.com and Buzzfeed.com, among other sites.
Gyllenhaal's pose in the photo is said to resemble a pose Grace Jones did for one of her album covers. Gyllenhaal's lawyers claim the photo is "defamatory" because the photo violates the actor's rights by "portraying him in a false light, violating his right of publicity and constituting a false designation of origin."
However, the legal action has backfired. Queerty.com said it planned to keep the photo up because " it hasn't been proven fake and because their letter bumped it from 'funny and cute' to 'actually newsworthy.'"

Unless you actively want Jake to look like a fool (or maybe I should say bigger fool), you shouldn't hope for this.
Where is Jake? In New York? Austin, TX? Filming 'End of Watch' somewhere?
