Maggie Gyllenhaal and Peter Sarsgaard, out dining together at the Ace Hotel in the heart of Manhattan Saturday night.

I remember when some paparazzi got egged in December 2008 when Jake and Reese were leaving a restauraunt, they were egged by the chef and waitstaff and Jake and Reese were laughing in their car and looked drunk.

The Kristen egg story makes me wonder if Jake asked the waitstaff to throw eggs at the paps, it does seem a bit of a coincidence?

HOLLYWOOD actor Jake Gyllenhaal got into a bar fight with a man who works on a celebrity gossip website after the man apparently accused him of killing his friend Heath Ledger.

Sources who were present told Ted Casablanca that the blogger in question said, "Hey isn't that the guy who killed Heath Ledger?" prompting Jake to yell to the bouncers "get these guys out of my face," reports E! Online.

The instigator and his crew were then thrown out.

The incident was sparked when Gyllenhaal started dancing on the bench of his table with some of his friends, which annoyed the blogger from the DrunkenStepfather blog.

It was at this point that the man approached Gyllenhaal and made the offending remarks.

The blogger tried to downplay the whole incident, insisting that he said "kiss," not "kill" but the sources reveal he is lying.

Casablanca reports that a post on DrunkenStepfather actually backs up this supposed kill claim by ranting in the item that if Jake was Ledger's friend, he probably would have been there for him in his low point.

Gyllenhaal is currently in Montreal filming Source Code.

For some bizarre reason, people seem to think that it's perfectly fine for Jake to visit other people on sets - Austin, Maggie, Kirsten, etc - but he doesn't need to receive the same kind of treatment from others. Atticus is all the comfort he needs from his family and close friends, right?

Yeah, and if you believe that, there's a bridge I can sell you for $10. Heck, I'll through in the Brooklyn Bridge for free!

He clearly needs that support, and obviously others do as well. That's why he visited them.

Maybe that's why he tolerated the stupid bearding business (beyond his contractual obligations, of course). At least someone visited him regularly on set.

Maggie, Peter, Dad, Mom, or Chris need to get on the plane or train ASAP. A phone call is not enough. For around 1000 reasons, some related to the closet, it ain't easy being Jake Gyllenhaal right now.

Once again, you're ignoring the reciprocity question. Appreciating a visit from a friend on set does not make Jake a baby. It makes him human! Everyone would appreciate that. Why is he any different?

This is where we differ: For you it seems the primary issue is the accusation that was directed towards Jake, and since it involves only Jake, that Jake was defending himself against the accusation. And it has nothing to do with Heath's "honor," am I correct? I'm not saying you are wrong, just that we see and value different aspects of the situation. For me the accusation means very little; it is the sanctity of respecting the dead and the people who knew them, that is important. For me it was the flinging of Heath's name and death in Jake's face, using it as a joke, and it dishonored Heath. Thus I feel that Jake was defending Heath's honor. But like I said, IMO it's just that we view different aspects of it. No one is wrong; it's very subjective.

Judge rules lesbian high-schooler's First Amendment rights violated

A federal judge ruled Tuesday that a lesbian high school student's First Amendment rights were violated when school officials told her she could not attend her prom with her girlfriend, but also ruled that he would not order the school district to hold the event.

In his 12-page order, U.S. District Judge Glen H. Davidson ruled that Itawamba Agricultural High School's denial of 18-year-old Constance McMillen's request to wear a tuxedo to her prom was also a violation of her rights. "The record shows Constance has been openly gay since eighth grade and she intended to communicate a message by wearing a tuxedo and to express her identity through attending prom with a same-sex date," Davidson wrote.

"The court finds this expression and communication of her viewpoint is the type of speech that falls squarely within the purview of the First Amendment."

When officials at the school in Fulton, Mississippi, told McMillen she could not take her girlfriend to the prom or wear a tuxedo at the event, the senior went to the American Civil Liberties Union, which demanded the school change its policy. In response, the Itawamba County School District canceled the prom.

But Davidson denied a motion for an injunction filed by McMillen against the school district's superintendent, the school's principal and its assistant principal asking the court to order that the prom be reinstated.

"Defendants testified that a parent-sponsored prom, which is open to all IAHS students, has been planned and is scheduled for April 2, 2010," Davidson wrote. "Though the details of the 'private' prom are unknown to the court, defendants have made representations, upon which this court relies, that all IAHS students, including the plaintiff, are welcome and encouraged to attend."

The case is going forward on a damages claim and the ACLU's request for attorneys' fees, she said. "She got what she wanted, and now it's just a question of what the damages might be in her case."

"I never thought the school would try to cancel the prom and hurt everyone just to keep me and my girlfriend from going together," McMillen said last week in an ACLU news release. "A lot of people have made really generous offers to pay for a prom somewhere else, which I really appreciate. But all I've ever wanted was to be able to just go to my own school's prom with my girlfriend."

At the center of the lawsuit is a February 5 memorandum from the school to students that said prom dates must be of the opposite sex.

Superintendent Teresa McNeece also told McMillen that she and her girlfriend could be ejected from the prom if other students complained about their presence, according to the documents.

This is where we differ: For you it seems the primary issue is the accusation that was directed towards Jake, and since it involves only Jake, that Jake was defending himself against the accusation. And it has nothing to do with Heath's "honor," am I correct? I'm not saying you are wrong, just that we see and value different aspects of the situation. For me the accusation means very little; it is the sanctity of respecting the dead and the people who knew them, that is important. For me it was the flinging of Heath's name and death in Jake's face, using it as a joke, and it dishonored Heath. Thus I feel that Jake was defending Heath's honor. But like I said, IMO it's just that we view different aspects of it. No one is wrong; it's very subjective.

Thanks for explaining yourself in a calm and rational way and not just flinging accusations about "trashing" Jake. I appreciate that. I do see where you're coming from and, of course, I agree that respecting the dead is important. I totally get why Jake was upset by such a disgusting remark. But I just don't see his actions as rising to the level of "defending Heath's honor." I'm not one of those people who believes Jake didn't care anything about Heath - I do think he cared. I just think this "defending Heath's honor" is overblown and kind of melodramatic - as far as we know, all he did was yell at the bouncers to get the guy out of there. Which is fine - that's what he should've done, I'm not putting him down for it. But you're right - it's subjective.

And the really sad irony of this whole disgusting mess is that Jake has spent two years purposely not talking about Heath in public (for whatever reason; again, that's not a criticism) and now all this ugliness has been forced on him and Heath's death and his connection with Heath is more of an issue and a topic of discussion than it has been in a long time.

There is clearly major confusion here over what "defend someone's honor" means. The key criterion is that the OTHER person's reputation, validity, or veracity is being attacked or questioned.

If someone says "X is a bad man" and you stand up and say, "No, leave HIM alone. HE is a good person," you are defending X's honor.

If someone says, "YOU are a bad person because YOU did something with/to X," and you stand up and react, you are SELF-defending in the first.

In other words, in order to have someone stick up for and defend X, someone else has to slander X.

DrunkenStepFather's flinging of Ledger's death in Jake's face did not primarily slander Ledger. It slandered Jake. In the second, you could argue it defamed their "friendship" or made a false statement about how Ledger died. But in legal terms, the only issue would be that it was an attack on Jake's professional character and allegation that he committed a crime of moral turpitude.

For what it's worth, a defense recognized in most jurisdictions is "opinion," i.e. if person makes a statement of opinion as opposed to fact, the statement may not support a cause of action for defamation.

As we had announced earlier today, the American actor Jake Gyllenhaal has had a mishap this weekend, when he was at the restaurant Garde Manger in Old Montreal.

We were fortunate to get an exclusive interview with the friend of Jesus Martinez, a blogger at the site Drunkenstepfather.com who has just released the story and of course was on the scene.

The friend of the blogger, who wishes to remain anonymous, shared her version of the story and responded to some of our questions.

HollywoodPQ: Could you tell us how things happened?

Friend: Me and my friend Jesus Martinez (Drunkenstepfather) were having a drink at Garde-Manger. There were few customers and the atmosphere was quite relaxed. It was then that Jake Gyllenhaal entered, accompanied by some people. There were several bottles on his table and he was really loud, dancing on his chair and laughing with his friends. It really looked like he was demanding more attention than was being granted. That contrasted sharply with the calm atmosphere of the place. My friend (Jesus Martinez) got up, said something to Jake. He (Jake) jumped up gesticulating and yelling, telling him to leave. So [Jesus] was escorted outside by staff of the place. I got up and went to tell Jake to calm down. Immediately, he began to shout "Who are you? Who are you to tell me to calm down?!" two inches from my face and then he pushed me on a table. I cried - after all I simply wanted to tell him to calm down!

A friend later took me aside and told me it was not a good idea to tell him that. Immediately after that, I left, while the restaurant staff just asked me to leave.

HollywoodPQ: How do you feel now?

Amie: It was a really bad experience ...

HollywoodPQ: Do you regret having gone to talk to him?

Amie: No. I think if an actor is in a public place, he must expect that people will say stuff to him. It's not like a movie set, where all those who work for him have to be nice.

The "pulling a Bullock" sounded strange to me, I couldn't figure out what he meant by that (not unusual; Ted purposely words things to be confusing so he can't be pinned down) - at first I thought he meant a break-up. There is no "scandal" surrounding Sandra Bullock. What has happened in her marriage happens a lot, in HW and elsewhere. I guess Tiger Woods is now yesterday's news; he and his sponsors will be glad - a scandal shelf-life is about a couple of months, tops.

All the tabloid covers this week are about Sandra Bullock, but the Chin got a mention on People magazine about her “romantic birthday getaway with new guy”. Let’s see if there is something about the drunkenstepfather incident inside any of the tabloids.

4) The accusation is uncharacteristic for the celebrity and their images (Jake being aggressive towards a woman is as unexpected as Sandra being involved with a guy who cheated with a tattooed racist woman working in porn)

tbh, that husband of hers always looked kind of dodgy, i wasn't that surprised. neither i was about Tiger Woods.

I don't believe the girl, there seem to be alot of people in the resturant, how come no one else has come forward (knock on wood) and validated her story. I don't mean wait staff but other customers. If she invaded his space maybe he felt threatend, she was also looking for trouble, why would you go back to someone who you claim was having a temper tantrum. Yes actors expect things to be said to them but DFS and his crew went looking for trouble.

Celebrities don't deserve a special treatment, but DSF and his girl friend were there to make trouble.

Normal person would ask Jake to quit dancing, stop singing, to be quiet, something that had to do with his behaviour - it it easy to understand that Jake was pissed off with both of them.

No, it hasn't. But for those in HW who are, I bet a lot of them had people around them with enough common sense to call 911 immediately, not call 4 other people first. Jake's being there or not is an outlandish thought. Unfortunately, Australia is a long way away as well. I think it was a tragic, tragic accident. ((((Heath)))))

One answer: publicity. Good or bad, it gets his name out there.

What is bothering me is the Gyllenhaal-pushing-a-girl-10-times allegation. The plot thickens because apparently, Garde Manger has camera surveillance, at least according to today’s Metro newspaper article.

It would be easy, provided the camera caught the right angle, to see if Gyllenhaal pushed the woman 10 times as she alleged.

Now the real question is, what is Garde Manger going to do with the tape? If Garde Manger destroys the surveillance tape or claims there was some sort of freak camera malfunction, I think we’ll be able to draw some fairly interesting conclusions about what really happened, don’t you think?

Jake's attorneys would be fools to not immediately ask the restaurant to save it's tapes--if it is not already too late.
