    Jake Gyllenhaal’s lawyers know that you’ve been thinking about him in his underwear, and they are not amused.

    Queerty got an email this afternoon from Jake’s law firm, asking that we remove the (probably fake) photo of him in his undies. We’re keeping the photo up, since it hasn’t been proven fake and because their letter bumped it from “funny and cute” to “actually newsworthy.”

    “Your publication of this fake photo violates many legal rights of our client by, among other things, defaming him,” says Jake’s lawyer.

    Oh, really? Defaming him? Well, we don’t like defaming anyone. You might even say that we are gays and lesbians allied against defamation.

    But what exactly is the defamation here? Is is that people might think, wrongly, that Jake wears underpants? Or that his reputation is sullied by the idea that he allowed someone to photograph him without pants on? Or that he stayed in what looks like a cheap motel?

    Simply calling something defamation doesn’t make it so, as Howard Stern learned in 2009 when he tried — and failed — to sue someone for suggesting that he’s gay. Is that what’s going on here?

    Jake’s a public figure, and we can talk about him if we want to. We can even speculate about what he looks like in his underwear. We can’t — and won’t — claim that this picture of him is definitely authentic, since we just don’t know. (A lot of people seem to claim that it isn’t, but internet-photoshop-experts are about as reliable as internet-lawyers.)

    In any case, if Jake wants us to take down a fake photograph of him in his underwear, all he has to do is provide us with a real photo and we’ll gladly post that one instead.

    Our law firm represents Jake Gyllenhaal. Your website has published a picture which purports to be a photo of our client in underwear imitating an album cover pose of singer Grace Jones. In fact, as anyone could tell from a cursory examination, this is a fake picture, in which our client’s head has been pasted on the body of another person. A number of websites have already taken the photo down in response to our request, and most of the remaining references to it on the web acknowledge that it is a fake. The photograph in question can be found at http://www.queerty.com...

    Your publication of this fake photo violates many legal rights of our client by, among other things, defaming him, portraying him in a false light, violating his right of publicity and constituting a false designation of origin in violation of the Lanham Act. Demand is hereby made for immediate removal of the fake picture.

Also, big websites don’t post them. This one was made to mock him and make people laugh at him. NO ONE likes to be laughed at like that.

  20. Fake Jake Gyllenhaal/Grace Jones Photo Not As Fake As Other Fake Jake Gyllenhaal Photos

    The photo on the left made the rounds yesterday and was of no interest me (you’ve seen one Photoshopped photo of Jake Gyllenhaal, you’ve seen them all), and today his reps are emailing all the blogs demanding that the fake photo be removed. It’s already been pulled from Dlisted and E!, and Queerty might be next, according to editor Oscar Raymundo. Suddenly, I am interested in this photo!

    If the photo is fake, as Gyllenhaal’s reps are claiming, that makes it satire. And Jake Gyllenhaal, who is a movie star, is legally allowed to be satirized.

    Unless one of Jake Gyllenhaal’s lawyers can explain to me why this satirical photo’s existence is illegal, the photo stays.

    Meanwhile, why get mad about this phony picture when there are so many more phony Jake Gyllenhaal pictures that actually show phony Jake Gyllenhaal cocks?!

    Actually the person you are describing is Jake. Jake being gay and in the closet seems to drive almost everything we see him do in public, including his reaction to this photo, and in turn that is what leads us to talk about the things we do.

    I fail to see what is so wrong with this picture that it would cause Jake to get lawyers involved, other than Jake having a problem with anything that makes him look gay.

    Slisted took it down, PITNB took it down before the letter because Trent realized it was fake.

    The rest of the blogs that have either deleted or chose to leave it up, it doesn't matter because nothing will be done by his lawers, it's all free PR for Jake and his team.

    I wouldn't be surprised if it was his team that did it, they sure took there time in issuing the letter...

    When a photo of Jake Gyllenhaal goofily posing like Grace Jones in her underwear emerged on the internet, many of us thought it was too good to be true. And of course it was (pretty obviously) Photoshopped, but still worth a chuckle. However, real Jake was not amused with fake Jake. He was so irked that he had his lawyers contact Buzzfeed (the site largely responsible for disseminating the pic) with a strongly worded letter urging them to take the photo down and threatening legal action if they didn't. You can read it in its entirety below. We're guessing they're not big fans of flamboyant, experimental disco-funk.

    I'm not sure why he's getting so riled up over faux-shirtless photos. It's not like there's a dearth of authentic ones on the internet, or even on his movie posters. His nearly-nude body plastered billboards and magazine covers for months during Love and Other Drugs promotional blitz last fall. Perhaps he wants people to know which abs are truly responsible for his floundering movie career.

    Still, I have a feeling that the big hit on the BBC's new slate will be My Week With Marilyn, an account of the time Marilyn Monroe spent in Britain in 1957, filming The Prince and the Showgirl opposite Laurence Olivier. Michelle Williams plays the effervescent sexy Marilyn, while Kenneth Branagh plays Olivier -- an irony, this, as he was tagged 'the young Olivier' (not always kindly) in the early part of his career. Eddie Redmayne has what looks like a career-changing role as a young production assistant whose job it is to escort the wayward Marilyn in her downtime.

    The reason I think My Week With Marilyn has a future was the reception its trailer received at a big splashy party thrown here in Cannes at the weekend by the Weinstein Company, which will distribute the film in the States. Company boss Harvey Weinstein screened half a dozen titles, and My Week With Marilyn -- which looks very affecting and amusing -- generated spontaneous, enthuisiastic applause.

The guy's not only been lying to fans for years, but actively creating a false identity that elevates heterosexuality to the pinnacle of esteem. I remember last year when he was coming out of the Giorgio Baldi Restaurant with Maggie and Peter and the reporter simply asked him about Prop 8 and he put his hand up like get away from me and said, "Yeah, yeah, yeah, yeah."

    He has shown not just a complete disregard for the truth, but an impetuous desire to eradicate all evidence of who he really is. Patience would not be the word I would choose to describe his behavior. How about petulance and peevishness, with a huge dose of pugnacity.

He looked gayer in the POP stills than in that photo. It does not cost much for a lawyer to write a letter. I doubt they ever intend to take it any further since they have minimal chance of proving any damages. What happened? He lost a part retroactive because of it?

How difficult would it be to print a boiler plate C&D, slap an LA law firm's name on it, and get a little extra mileage out of the pic? Not very.     It was very easy to get Jake's lawyer's name, address, email, etc. Remember the C&D letter this lawyer sent to that real estate agent in SC when he was filming Nailed? They posted the address of where Jake was staying and the real estate agent posted the letter, it's very easy for any on to copythat info and keep in on file for future use.

    E/ted never actually posted the pic, just linked to it. Then he claimed that he heard from his people that it was fake (which i don't buy because he knew in the begginning it was fake, he couldn't be that dumb) then he said you better get a good look because his lawyers were going to ask to have it removed from all sites, again I find it hard to believe Jake's people would be talking to Ted about anything.

    Also that letter is very unprofessional, doesn't sound like a lawyer talking here, and yet if it was fake why hasn't anything being done? It's all very odd.

  118. The thing is that the letter was put out there w/o the e-mail, cell#, etc redacted, just like the S. Carolina letter, that's a no-no and zi don't think that the real estate agent redacted that info, meaning that Jake's lawyer doesn't sem to concerned about having that info on the net. Also he sent a letter to Drunken stepfather about that incident in Montreal and asked him to take the post down.

    He said he wouldn't take it down and I don't think he did and i don't know if he posted the letter.

    IMO, the letter came from that office but it wasn't from the lawyer but one of his assistants.     Indeed. Gyllenhaal's lawyers allege the photo violates the actor's legal rights by "portraying him in a false light, violating his right of publicity and constituting a false designation of origin in violation of the Lanham Act."

    At least one photo expert believes the image is a fake, so perhaps Gyllenhaal isn't stretching. No, maybe just his lawyers.

    First, does the picture really damage Gyllenhaal's reputation? Jake isn't the first actor to allege defamation by photoshop — see Demi Moore vs. W Magazine — but this is a pretty unique situation. Maybe Gyllenhaal believes he won't earn big bucks as a leading man if people think he prances around in his underwear (and allow himself to be filmed as such).

    As for the publicity and Lanham Act claims, Gyllenhaal might have to trot out experts testifying to the value of a market in Gyllenhaal underwear photos being damaged by the appearance of this image. Who knows? Maybe Gyllenhaal really could be the paid spokesperson for Fruit of the Loom. We'd love to see the briefs. The legal ones, that is.

    This photo doesn't even come close to a "repose" of the Grace Jones cover. It's called dancer pose and I do it every single day, often in my underwear. Anyone who practices yoga does this pose for balance and stretching quads, often in the morning.

    If this pic were real, I'd think nothing of it except that his slumber partner got a little handy with the camera.

The whole attorney C&D letters have made him the talk of the internet and not in a good way and have doubled the interest in the picture. Even sites that would probably never discuss Jake, like techland.time.com, are laughing at him for not having a sense of humor, for picking such a lame manip to sue about, for the pic really not causing his career to suffer because it's already failing and for doubling the interest in the pic.     Unless you actively want Jake to look like a fool (or maybe I should say bigger fool), you shouldn't hope for this.
